Who operates this site

The website bleustorm.bg (the “Site”) is operated by EL EY APART EOOD, UIC 204872578, with its registered office and address of management at Floor 8, Entrance A, Block 6A, Fondovi Zhilishta, Serdika District, Sofia 1233, email info@bleustorm.bg (“we”, “us”, the “Company”).

EL EY APART EOOD is the importer and distributor of BleuStorm in the Republic of Bulgaria. BleuStorm is a trademark of its owner and is used on the Site with its permission.

Acceptance of these Terms

These Terms and Conditions (the “Terms”) govern access to and use of the Site. By accessing the Site you confirm that you have read the Terms and accept them in their current version.

If you do not accept the Terms, please stop using the Site.

The Terms should be read together with the Privacy Policy and Cookie Policy, which form an integral part of them.

Age restriction

The Site is intended exclusively for persons aged 18 or over, in accordance with the laws of the Republic of Bulgaria.

On your first visit the Site asks you to confirm your age. By confirming, you declare that you are 18 or over. If you are not, you may not use the Site and should leave it.

Please do not give persons under 18 access to the Site or share its content with them. Access to the Site can be restricted with parental control software or through your device settings.

Nature of the Site

The Site is informational and presentational. No alcoholic beverages are sold through it, no orders are accepted and no payments are processed.

The content of the Site is not a public offer or an invitation to enter into a contract. Enquiries about trade terms, points of sale or partnership can be sent through the contact form or to info@bleustorm.bg.

Product information

Descriptions, tasting notes, information on composition and origin, and details of awards are provided for information only.

For any particular bottle, the information on its label prevails. Where the Site and the label differ, the label takes precedence.

Images are illustrative. Packaging, volume and design may vary by batch and market. The awards listed refer to the year stated and to the sample assessed.

We make no commitment about the availability of the product at any particular retailer.

Intellectual property

All rights in the content of the Site, including text, images, video, graphics, design, structure and code, belong to the Company or its licensors, including the owner of the BleuStorm trademark.

You are granted a limited, non exclusive and revocable right to view the content and to print or save individual pages for personal, non commercial use, provided that all copyright and trademark notices are kept.

Without our prior written consent, the content may not be reproduced, distributed, published, modified, translated, used to create derivative works or used for commercial purposes.

Media representatives and trade partners may request official materials at info@bleustorm.bg.

Permitted use

When using the Site you agree not to:

• breach or attempt to breach the security of the Site, or gain unauthorised access to any part of it or to systems connected with it;
• use automated means to extract content or data, other than legitimate indexing by search engines;
• reproduce the Site or parts of it within a frame on another site, or remove or alter copyright and trademark notices;
• use content from the Site in a way that encourages drinking by minors, excessive drinking or driving after drinking, or that presents drinking as an achievement or a route to success;
• use the Site to spread malicious code or for actions that interfere with its operation;
• impersonate another person or a representative of the Company.

We may restrict or terminate access to the Site if the Terms are breached, and may change, suspend or remove parts of the Site at any time.

Contact form

The contact form is intended for enquiries to the Company. Data sent through it is used solely to respond to the specific enquiry.

Please note that:

• the form is not a channel for orders, payments or urgent matters;
• you should not send sensitive personal data, health information, bank details or passwords through it;
• you are responsible for the accuracy of the data you provide, and when you give another person’s details you confirm that you have their consent;
• messages sent are processed in accordance with the Privacy Policy.

To protect against abuse and unwanted messages, the Site applies technical measures, including limiting the number of submissions from a single address.

If you send us unsolicited ideas, concepts or proposals, they are not treated as confidential and create no obligation of payment or confidentiality, unless we have expressly agreed otherwise in writing.

The Site may contain links to third party sites. We have no control over their content and accept no responsibility for it or for their data protection practices. A link does not imply endorsement or affiliation.

Availability of the Site

We make reasonable efforts to keep the Site available and its content accurate and up to date, but we do not guarantee uninterrupted or error free access. Interruptions may occur for maintenance, updates or reasons beyond our control.

The Site is provided as available. We recommend checking important information against another source before acting on it.

Liability

To the extent permitted by law, we accept no liability for damage arising from inability to access the Site, interruption of its operation or use of its content.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Bulgarian law, including liability for intent or gross negligence, liability for death or personal injury, and consumer rights under mandatory provisions of law.

Responsible drinking

Drink responsibly. Not for sale to persons under 18.

Do not drive after drinking alcohol. Drinking alcohol is not recommended during pregnancy or breastfeeding, with certain health conditions or when taking medication.

Changes to the Terms

We may change these Terms. The current version is published on this page, and its effective date is shown at the top.

Amended Terms apply from the moment they are published. We recommend checking this page from time to time.

Governing law and disputes

These Terms and all relations connected with use of the Site are governed by Bulgarian law.

Disputes are resolved by negotiation. If no agreement is reached, the dispute is referred to the competent Bulgarian court. This does not affect any rights you have as a consumer under the mandatory law of your country of habitual residence.

Reports of infringed rights

If you believe that content on the Site infringes your intellectual property rights or other rights, send a report to info@bleustorm.bg, including your contact details, a description of the work or right concerned, the specific address (URL) of the content, and the grounds on which you believe the use is not authorised.

We review reports received within a reasonable time.
